Jobbit serves as a digital platform connecting Clients and Service Providers, facilitating the provision of short-term services ("Services"). Clients and Service Providers collectively referred to as "Users," engage in the Jobbit platform to establish direct Service Contracts upon mutual agreement on service terms. All Service Providers using the Platform operate independently. They are not affiliated with Jobbit in any employment or contractual manner. Jobbit only serves a virtual hub, linking Clients with Service Providers. By using the Platform, Users understand that Jobbit doesn't oversee or control any service offered. Jobbit hereby disclaims any legal obligation or guarantee regarding the Services, including without limitation warranties as to quality or compliance with ethical or regulatory standards or with applicable laws.
Labels on the Platform indicating a Service Provider's credentials, reliability, or other endorsements merely indicate the completion of certain criteria. It does not constitute and must not be construed as an official endorsement or guarantee of any Service Provider on the Platform. Clients are advised to exercise their judgment when selecting Service providers. Jobbit merely facilitates interactions between users for service fulfilment. It doesn't have any influence over or responsibility for the actions, quality, or any aspect of services or interactions between Users. No assurances are made regarding the appropriateness, punctuality, or precision of the Services requested or delivered through the Platform.
Prior to and during their association with the Platform, Users may undergo a series of evaluations. These could include, among others, verifying their identity and conducting checks on criminal history, with the aid of external service providers when necessary, referred to as "Background Assessments". While Jobbit strives to conduct these Background Assessments, it may not always be possible for Jobbit to validate the authenticity of every User. The Platform does not bear or assume any responsibility for the precision or dependability of the information from the Background Assessments. Whenever you engage with other Users, it's prudent to exercise discretion and general sense to safeguard your personal safety, information, and belongings, just as you would when meeting unfamiliar individuals. Jobbit will not assume responsibility for any deceptive or incorrect declarations made by Users of the Platform.

You acknowledge and consent that a legally binding agreement with another User (referred to as the "Service Contract") is established when you and the designated User reach a consensus on job terms. The Service Contract encompasses the terms outlined in this Section 3, the engagement conditions presented and confirmed on the Platform, and any additional contractual conditions mutually acknowledged by the Service Provider and the Client, provided they do not conflict with the terms of this Agreement or expand Jobbit's responsibilities or restrict Jobbit's rights as defined in these Terms & Conditions. Jobbit is not a party to any Service Contract. Creating a Service Contract does not, at any given time, create an employment relationship between Jobbit and the Service Provider, nor does it establish an between the Client and the Service Provider except as expressly permitted by these Terms & Conditions or agreed to in writing between the Client and the Service Provider. Users aren't permitted to forge any oral or written contracts, whether overt or covert, representing Jobbit. Service Providers may with the consent of the Client seek the support of associates, aides, subcontractors, or other team members (termed "Provider Assistants") in the performance of the Services. It's pivotal, considering safety, that these Provider Assistants are registered on the Platform. Failure by a Provider to adhere to this clause could result in potential removal from the Platform. Service Providers assume complete accountability for any acts or omissions by the Provider Assistants. This encompasses legal compensation, potential benefits, and any associated tax obligations. It is also the responsibility of the Clients to ensure that all Provider Assistants are registered members of the Platform.
While utilizing the Platform, Clients have the discretion to decide whether they want to be physically present during job execution. In cases where a third party, other than the Client, schedules the job or is present during the task's execution, this individual is recognized as the Client's representative ("Client's Representative"). Service Providers are authorized to follow instructions from the Client's Representative as if they originated from the Client. If you are acting as a Client's Representative and utilizing the Platform on behalf of a Client, you affirm that you possess the necessary authority to represent and legally bind the Client to all terms of service. Any directives or potential waivers of the Client's instructions, related to the Provider's job undertaking, authorized by the Client's Representative, are considered valid. The Client assumes responsibility for such directives or waivers as if personally issued. Clients bear sole responsibility for any actions or oversights by their Client's Representatives. These Representatives are considered external parties concerning the Satisfaction Guarantee and are therefore exempt from its provisions.
All payments for tasks are to be processed through the Payment Service Provider (PSP) as mentioned on the Platform, based on rates mutually agreed upon in the Service Contract. Every User commits to honoring both the Service Contract and these Terms & Conditions throughout the task's engagement, execution, and culmination.
Jobbit Ltd. ("Jobbit") facilitates connections between clients and service providers through our platform, offering a secure environment for transactions related to a wide array of services. A nominal fee of 5%, which includes payment processing fees charged by Stripe, is applied to transactions conducted on the Jobbit platform.
Jobbit is not a financial institution or creditor. We temporarily hold user funds solely for the purpose of facilitating transactions for services on our platform. Users have the option to request a return of unutilized funds at any time, subject to our terms and conditions.
Users of the Platform make agreements for tasks directly amongst themselves. Jobbit does not act as a direct party in these contractual agreements. It is the Client's responsibility, not Jobbit, to ensure payment for tasks facilitated exclusively through the Platform, using the designated PSP. Jobbit is under no obligation to reimburse Service providers if a Client defaults on payment.
The Jobbit commission fee (equal to 5%) is processed through the platform, when client's funds are transferred to the service provider balance upon completion of a task. The jobbit commission fee includes the fees taken by the PSP. Clients using the Platform are required to share their payment details with both Jobbit and the PSP. Jobbit processes this information in line with its Privacy Policy. Service Providers must promptly send accurate bills to their Clients within one (1) day after completely rendering their services. Invoices for each job (referred to as "Invoice(s)") shall include:
A Client may choose to add a tip or bonus to the invoice, which will be directly passed on to the Service Providers. Clients may incur a card processing fee equal to 1.5% + 20p for standard UK cards (2.5% + 20p for EU cards) of the total amount. Service Providers may also bear registration charges, if they apply, and are responsible for refunding any mistaken payments.
To receive their payments, Service Providers may need to create an account with the PSP. This may involve registering with the PSP, agreeing to its terms, and undergoing any verification procedures the PSP requires. Service Providers, by adhering to these terms, confirm they've gone through and accepted the PSP Service Agreement. It's important to note that Jobbit is not part of the PSP Services Agreement, and thus, bears no obligations or liabilities under it. For security reasons, to thwart potential fraudulent activities and to ensure the protection of user data, both Jobbit and/or the PSP may verify a User's account before its activation and before every transaction. This may involve placing and then refunding temporary charges on a User's account, with the amount based on the anticipated value of the job and associated expenses. Once a job's completion is confirmed by the Client on the Platform or via email, the Client grants the PSP the permission to process the invoice(s). If a Client schedules but then revokes a job prior to its designated start time, they could face a cancellation fee, equivalent to an hour's charge at the Service provider's rate, processed through the PSP. Jobbit retains the authority, upon a request or if suspicious activity is noted, to freeze any job payment, incidental expenses, and/or tips, or facilitate refunds or credits through the PSP.
Users of the Platform may be subject to any applicable taxes or similar levies (like VAT, where relevant). In specific regions, regulatory norms may mandate us to gather or share tax or revenue details pertaining to our Users. By using the Platform, you grant Jobbit permission to produce any necessary documentation for precise tax declarations.
5.1 Jobbit is committed to ensuring a fair and transparent process for both clients and service providers. In the event of a dispute arising from a service exchange, Jobbit implements a dispute resolution scheme as follows:
This dispute resolution scheme is exclusively available for transactions processed through the Jobbit platform.
If a client does not confirm the completion of an order, or does not respond to inquires from service provider or dispute resolution agent within 7 days from the date the service was rendered, then held funds will be automatically transferred to the service provider. This policy ensures timely compensation for service providers while encouraging clients to promptly review and approve completed services.
Jobbit strongly advises all users to conduct transactions directly through our platform to benefit from our security measures, including the dispute resolution scheme. Jobbit cannot and will not be liable for any losses, damages, or fraud resulting from transactions conducted outside the Jobbit platform or through alternative payment methods. By choosing to engage in transactions outside of Jobbit's secured environment, users acknowledge and accept the potential risks and agree that Jobbit shall not be held responsible or liable for any outcomes of such transactions.
Jobbit may regularly introduce various promotional ventures and competitions to its Users. These initiatives are entirely under the discretion of Jobbit and can be introduced, altered, or terminated at any moment without prior notice. Any liabilities of Jobbit, its Affiliates, or any of Jobbit's enterprise associates concerning these ventures will align with the stipulations in Section 17 of these Terms & Conditions. Jobbit's voucher tokens ("Voucher Tokens") and discount vouchers ("Discount Vouchers") may be available for use. These can offset Job Payments, the Jobbit commission fee either partially or entirely. They may not however be applied towards compensation for ancillary expenses, gratuities, or tips linked to jobs facilitated through the Platform.
Discount Vouchers serve as an initiative by Jobbit to decrease the sum a Client owes related to a Job Payment, service charge, and/or the Assurance & Assistance fee. These vouchers won't influence the payment a Provider ultimately gets. The utilisation or employment of any Discount Voucher is purely promotional and doesn't foster any connection or engagement between Jobbit, the Service Provider, or the Client, nor are they perceived as wages or fees to the Service Provider. You consent to use Discount Vouchers in line with their associated terms. A newcomer Discount Voucher may be employed just once for every User, regardless of the registering email address. Jobbit holds the right to withhold or revoke credits or perks acquired through the misuse of a Discount Voucher, should its use or redemption be mistaken, deceptive, unlawful, or contradicting the relevant Discount Voucher stipulations or these Terms & Conditions.
Voucher Tokens may be exclusively used for tasks executed via the Platform. If misplaced or stolen, they aren't replaceable and lack an expiry date. They're devoid of monetary equivalence and may not be converted into cash. Clients must directly input Voucher Tokens into their accounts. Service Providers shall not directly accept them as a payment method. Merging multiple Voucher Tokens or using them in conjunction with other Voucher Tokens, gift vouchers, or Discount Vouchers is expressly prohibited. Your Voucher Token isn't linked with any credit facilities, such as credit cards, credit lines, overdraft safeguards, or deposit accounts. At present, there's no option to "recharge" or add funds to your Voucher Token. If a purchase exceeds a Voucher Token's value, the extra amount must be paid through alternative means. Unused Voucher Token balances can't be transferred. Jobbit retains the right to rectify a Voucher Token's balance if we suspect a billing inconsistency. Jobbit may also limit the number of Voucher Tokens acquired by any User and may nullify a Voucher Token if it is believed to be fraudulently or illicitly obtained. Using a Voucher Token denotes the User's acceptance of this section and commitment to adhering to all Voucher Token terms and stipulations as may be communicated by Jobbit from time to time.

The Platform may include user profiles, messaging systems, blogs, review sections, discussion boards, job listings, chats, news forums, groups, and other communicative features (hereafter termed "Community Spaces"). These spaces are for Users to engage with fellow Users. It's vital that interactions within these areas are relevant and appropriate to the respective forum. For the security and credibility of the Platform, it's advised not to disclose personal contact details to other Users.

7.4. Any content shared within the Community Spaces is public knowledge and shall be treated as non-confidential and non-proprietary. Your actions and interactions within these spaces will be associated with your name or user ID. Jobbit hereby disclaims liability for any User's actions related to materials or information shared within these spaces.
Upon setting up the Jobbit Mobile Application (the "App"), and any other related application (collectively the "Apps") you confirm your acceptance to these Terms & Conditions and the terms of use of the Apps. These Terms collectively apply to the Apps and along with any subsequent updates or enhancements provided via the Platform. The Apps may (i) prompt your device to autonomously connect with Jobbit servers to offer the App features and document usage statistics, (ii) influence preferences or information linked to the App saved on your device, and (iii) gather personal details in accordance with our Privacy Policy. You may choose to delete the Apps whenever you wish.
Jobbit may temporarily suspend your access to the Platform while examining a potential infringement of these Terms & Conditions. If Jobbit concludes that you've violated any terms within these Terms & Conditions (referred to as a "User Violation"), it may in its discretion either disable your account or restrict certain functionalities. Jobbit will duly notify you in writing of its decision, in compliance with legal requirements, unless there's an underlying concern that the account's security may be jeopardised, causing the communication to be misdirected or to pose safety risks. Should you wish to contest this decision, you're encouraged to reach out to policies@jobbit.com, outlining your reasons, within 14 days of receiving the initial notice. If Jobbit restricts, terminates, or suspends your account as per this Section 8, you're subsequently barred from setting up a new account, either under your personal or business identity, an assumed identity, or on behalf of another entity.
Notwithstanding the limitation, termination, or suspension of access to your account, the terms of these Terms & Conditions continue to be binding on you. Jobbit retains the authority to undertake suitable legal measures to enforce compliance with these Terms & Conditions.
Jobbit holds the discretion to alter or halt, either temporarily or permanently, any part of the Platform. Should such changes occur, Jobbit will notify you as per our legal obligations. Save as expressly provided under applicable law, Jobbit hereby disclaims liability for any alterations or suspensions to the operation of the Platform or any of its functionalities. Jobbit maintains the prerogative to prevent certain individuals from registering on the Platform if such actions may jeopardise the Platform's safety and integrity or to cater to other valid business considerations.
To ensure access to the Platform, Users are required to sign up with Jobbit and create an account. The confidentiality of any login credentials, password, and account number shared by you or provided by Jobbit for accessing the Platform is under your responsibility. You bear complete accountability for all actions that transpire under your account or password, even if they weren't endorsed by you. Jobbit has no direct control over the utilisation of any User's account and explicitly disclaims any responsibility stemming from such usage. If you believe that someone may be misusing your account or password or if you detect any security breaches, you commit to inform Jobbit promptly. By using the Platform, you understand and agree that phone conversations with or from Jobbit, as well as its representatives and associated entities, may be tracked and documented to maintain quality standards and for training purposes. You affirm that the contact details you've shared with Jobbit, its representatives, associated entities, and Users, which includes but isn't limited to your personal or business name, postal address, email, home or business phone number, or mobile number, are accurate and legitimate. You confirm that you're the present owner or subscriber of any phone number you share. Sharing a phone number that isn't genuinely yours is strictly prohibited. If it emerges that the data shared during your sign-up is erroneous, misleading or deceptive, your account may be suspended or terminated at our sole discretion and without liability to you. If there's any change in your contact information, especially concerning the ownership of your phone numbers, you're obligated to inform Jobbit promptly. You can update Jobbit by replying STOP to any message sent to the number you're relinquishing, before the change becomes effective.
The term "User-Provided Content" encompasses all data and materials shared with Jobbit, its representatives, affiliates, corporate allies, or other users during registration, platform usage, or participation in Jobbit promotional initiatives. This explicitly includes materials shared or broadcasted in public domains. You acknowledge that you bear full responsibility for the User-Provided Content, and Jobbit acts solely as a passive conduit for the digital dissemination and publication of such content. You understand that Jobbit is not involved in the creation or enhancement of User-Provided Content, disclaims any liability for it, and is not responsible for any issues arising from it. Furthermore, you recognize that Jobbit is not obligated to monitor User-Provided Content but reserves the right to restrict or delete content that does not comply with these Terms & Conditions.
By posting content on the Platform or any of our Community Spaces, you guarantee to Jobbit that your User-Provided Content will:
The Platform showcases User-Provided Content concerning Service Previews and ratings ("Feedback"). Such Feedback represents the personal views of Users and not Jobbit's personal opinion. Jobbit has no obligation to check Feedback and does not directly or indirectly endorse any Feedback on the Platform. Jobbit urges users to provide candid, constructive feedback about their interactions. Jobbit may evaluate user comments for veracity. We however have no obligation to do this. Users agree to perceive Feedback as an expression of individual experiences and not hold diverging views against Jobbit. In case of any content violations, users can request rectifications via the support channel. Before engagement and executing a Service Contract, Clients are advised to individually verify a Service Providers qualifications. Jobbit values the rights of individuals and anticipates similar respect from its Users. In instances where rights seem compromised due to User-Provided Content, Jobbit may disclose user identities to the concerned parties for conflict resolution. Should any User believe that certain content on the Platform violates rights or is inappropriate, they are encouraged to promptly notify Jobbit. Particularly grievous concerns, such as promoting hate, violence, or child exploitation, must be immediately reported. Notifications can be addressed to Jobbit at a specified address.
The Platform may feature links, such as hyperlinks, pointing to websites operated by third parties. The presence of these links doesn't imply Jobbit's endorsement or any affiliation with these external sites, their content, or their operators. These links, which may include sites framed within the Platform or associated advertisements, are shared for informational purposes and User convenience. Jobbit doesn't have authority or control over these third-party sites and is not in any way accountable for their accessibility, accuracy, correctness, content, promotions, products, or services. Users are required to assess the value and relevance of details from these external sites and read through their respective terms and conditions before subscribing to them. You recognize and consent that Jobbit doesn't partake in the establishment or design of third-party sites and waives any responsibility for such sites. Jobbit shall not be held responsible for issues stemming from these third-party sites. Moreover, you acknowledge that Jobbit isn't obligated to oversee or remove these third-party links but maintains the right to regulate or eliminate these links from the Platform at its sole discretion. All third-party sites linked on the Platform are governed by their own terms of use and privacy policies. Users venture into these third-party sites at their own discretion. Jobbit categorically renounces any accountability associated with your interactions or engagements with any content or links originating from third-party sites. You agree to absolve Jobbit and its Affiliates from any potential liabilities resulting from your use of links available on the Platform.
Jobbit functions as a digital hub, linking clients to Service Providers eager to undertake various services. Jobbit does not itself execute these services and doesn't hire individuals for these roles. Service Providers function as autonomous business proprietors, typically involved in a self-established profession similar to the services they provide to Clients via the Platform. Jobbit does not oversee the way Service Providers render their Services, nor does it dictate their work locations, hours, or conditions. Service Providers offer their Services under their individual or business name, separate and distinct from Jobbit's branding. They are exclusively responsible for equipping themselves with the necessary tools and resources required to perform the Services. Service Providers have the liberty to cultivate their own client base without interference from Jobbit and can extend their services on other platforms, even if they're in direct competition with Jobbit. They hold the freedom to choose or decline clients and agreements. While there's no backlash for declining offers, once a Service Provider commits to a client or contract via Jobbit, they are bound to meet those obligations. Service Providers independently determine their pricing for the services they list on the Jobbit's general marketplace, and Jobbit does not enforce any deductions. The Platform doesn't function as an employment intermediary or business entity, and it doesn't categorize any User as an employee. Service Providers recognize and affirm their obligation to apply their independent business discretion when forging Service Contracts and executing the Services. They acknowledge that their choices could lead to potential profits or losses, contingent on their decisions.
The Satisfaction Assurance, applicable to the jurisdiction where the service is performed, is incorporated into these Terms & Conditions by reference. Service Providers select their areas of expertise and negotiate service specifics directly with their Clients. Jobbit neither supervises nor dictates how a Service Provider carries out a service, nor does it actively monitor services or chat exchanges between Platform Users. It also disclaims responsibility for user behaviors. Clients are encouraged to assess a Service Provider's proficiency before commencing a service. Jobbit is not liable for any actions or oversights by Users and does not provide compensation for losses incurred by Users. Nevertheless, Jobbit aims for positive interactions on the Platform, and the Satisfaction Assurance is designed to promote consistent Platform usage.
Compensations granted under the Satisfaction Assurance are solely at the discretion of Jobbit and are subject to specific prerequisites, restrictions, and exceptions as outlined in the Satisfaction Assurance. The Assurance does not supersede any clauses in these Terms & Conditions or the Privacy Policy, especially any limitations on Jobbit's liability within these Terms & Conditions. In the rare event of a conflict with the terms of the Satisfaction Assurance and these Terms & Conditions, the relevant terms of these Terms & Conditions will prevail to the extent of such inconsistency. The Satisfaction Assurance is not an insurance policy, and Jobbit shall not be recognized as an insurance provider in the conventional regulatory sense.
Every element, including text, illustrations, editorial insights, datasets, layouts, charts, configurations, HTML code, visual interface, photos, audio elements, visuals, software, video clips, fonts, and other contents on the Jobbit Platform, not excluding Jobbit's distinct designs, trademarks, and symbols (termed as "Exclusive Contents") observed by Users on the Platform, is the exclusive property of Jobbit. This doesn't encompass User Provided Contents, for which Users accord Jobbit a usage license as described previously in Section 10. All forms, channels, and new or upcoming technologies safeguard this Exclusive Content. Jobbit holds complete ownership rights over this Exclusive Content, encompassing its coordination, choice, organisation, and all future improvements. Domestic and global regulations that preside over copyrights, patents, and various proprietary entitlements apply to and protect this Exclusive Content. Users are prohibited from replicating, downloading, reverse engineering, adapting, altering, or forwarding any material from the Platform without a clear written authorisation from Jobbit, and where relevant, permission from the rights holder of the User Provided Content. Unauthorized utilization of the Exclusive Content is strictly prohibited.
Distinctive symbols and trademarks of Jobbit, such as (but not confined to) Jobbit and its corresponding logos, are proprietary marks of Jobbit. Any other symbols, trademarks, service marks, or trade names found on the Platform belong to their individual owners. The proprietary symbols and logos of Jobbit are off-limits for all Users without Jobbit's express permission. Replicating or utilizing any of these symbols, emblems, or trade names without the explicit written approval from its rightful owner is not allowed.
Jobbit values the intellectual property of others and anticipates the same from its Users. If you genuinely believe that any content presented on or related to the Jobbit platform encroaches upon your copyright or another intellectual property right, kindly furnish the following details to Jobbit's Designated Intellectual Property Agent at Jobbit Ltd, [20 Gillender Street, London, England, E3 3YJ], or by email to business@jobbit.uk (use business@jobbit.uk for individuals in the UK):
You understand that all Sensitive Details (defined below) stands as an invaluable, distinct, and exclusive property of Jobbit. You commit that for the entire duration your account remains active on Jobbit, and for the later of (i) five (5) years post its deactivation; or (ii) the highest limit permitted by applicable law, you shall not reveal, distribute, or employ (nor encourage others to do so) any Sensitive Details for purposes other than using the Platform in line with these Terms & Conditions. Where applicable, you may disclose Sensitive Details to your approved staff and representatives only if they are equally obligated to uphold the confidentiality of such information. You agree to apply utmost diligence in safeguarding the Sensitive Details from unauthorised dissemination, distribution, or employment. Immediately upon recognising any potential scenario of unauthorised handling of the Sensitive Details, you are to notify Jobbit in writing. Upon the deactivation of your User account or the termination of these Terms & Conditions for any reason, all original materials and any duplicates containing Sensitive Details must be returned to Jobbit without delay.
For the purposes of these Terms & Conditions, the term "Sensitive Details" encompasses all trade secrets, confidential insights, and all other data from Jobbit that aren't publicly acknowledged or known to third-party entities who could gain monetary or other benefits from its access or revelation. Sensitive Details are inclusive of, but not confined to, technological datasets, expertise, research, future product blueprints, existing products, services, clientele, market insights, software advancements, innovations, methodologies, recipes, technological advancements, schematics, engineering notes, hardware specifics, marketing strategies, financial data, exclusive contents, and other confidential details associated with Jobbit or its business functions, including intel about Jobbit's personnel, users, associates, or any commercial information, whether acquired directly or indirectly, in written, verbal, graphical or observed forms.
THE PLATFORM'S TECHNOLOGY IS PROVIDED "AS IS," WITHOUT ANY PROMISES, IMPLIED OR DIRECT, INCLUDING, BUT NOT RESTRICTED TO, THE IMPLIED WARRANTIES OF SUITABILITY, MERCANTABILITY, FITNESS FOR A SPECIFIED USE, QUALITY OF SERVICE, OR NON-VIOLATION. JOBBIT DOES NOT GUARANTEE OR CLAIM THE COMPLETENESS OR PRECISION OF CONTENT AVAILABLE THROUGH THE PLATFORM OR ON WEBSITES LINKED TO IT. IN TERMS OF (I) CONTENT ERRORS OR OMISSIONS, (II) DAMAGE TO PROPERTY OR PERSONAL INJURY FROM ENGAGING WITH THE PLATFORM, (III) INTERACTION WITH OUR SECURE SERVERS, INCLUDING ANY PERSONAL OR FINANCIAL INFORMATION STORED THERE, AND (IV) CIRCUMSTANCES BEYOND OUR DIRECT CONTROL, JOBBIT DISCLAIMS LIABILITY WHETHER UNDER CONTRACT, WARRANTY, TORT OR NEGLIGENCE.
JOBBIT DOES NOT ENDORSE OR ASSUME RESPONSIBILITY FOR ANY SERVICES ADVERTISED BY THIRD PARTIES ON THE PLATFORM, THROUGH LINKED WEBSITES, OR IN ANY ADVERTISEMENTS. USERS ARE ADVISED TO EXERCISE DUE DILIGENCE AND CAUTION WHEN PURCHASING PRODUCTS OR SERVICES. ADDITIONALLY, JOBBIT AND ITS AFFILIATED ENTITIES DO NOT GUARANTEE UNINTERRUPTED ACCESS TO THE PLATFORM OR THAT IT WILL BE ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE BEHAVIOR OF ANY USER, ONLINE OR OFFLINE, AND DO NOT WARRANT THAT THE PLATFORM IS FREE FROM HARMFUL ELEMENTS SUCH AS VIRUSES OR MALWARE. NEVERTHELESS, JOBBIT WILL IMPLEMENT NECESSARY TECHNICAL MEASURES TO ENSURE THE SECURITY OF THE PERSONAL INFORMATION YOU PROVIDE. IRRESPECTIVE OF ANY TOOLS PROVIDED BY THE PLATFORM, CLIENTS BEAR SOLE RESPONSIBILITY FOR DEFINING THE JOB AND SELECTING THEIR SERVICE PROVIDER(S). JOBBIT DOES NOT ENDORSE ANY GOODS OR SERVICES PROCURED BY A CLIENT AND DOES NOT FAVOR ANY SPECIFIC SERVICE PROVIDER. WE PROVIDE NO ASSURANCES REGARDING A SERVICE PROVIDER'S CAPABILITY OR PROFESSIONAL CREDENTIALS.
By using the Platform, you acknowledge and accept that Jobbit operates under specific liability constraints. Therefore, you agree not to hold Jobbit and its associated entities or partners liable for any claims, damages, costs, losses, or other liabilities arising from your engagement or any other party's engagement with the Platform. This includes issues related to any user's behavior, interactions with other users or third-party service or product providers, or any content you provide. Jobbit and its affiliates and partners shall not be held liable for any direct or indirect, consequential, or incidental damages arising from your use of the Platform, even if advised of such potential damages. Depending on jurisdiction, some restrictions or warranty exclusions may not apply to you in their entirety. Jobbit explicitly denies any responsibility arising from user interactions on its Platform. The quality or suitability of any work done through the Platform is not guaranteed by Jobbit. Notwithstanding the foregoing, the total liability of Jobbit and its Affiliates if any shall not exceed the lesser of (i) the total amount paid to Jobbit by the User (if you are a client) or received from clients (if you are a service provider) over the past six (6) months; or (ii) the highest amount permitted under applicable law.
You hereby commit to safeguard, champion, and absolve Jobbit and its associated entities from any and all obligations arising in relation to: (i) your engagement with, or inability to engage with, the Platform; (ii) your involvement in tasks, or your capability or incapability to execute or obtain execution of tasks, or to acquire payment for such tasks; (iii) any breach or infringement of this Agreement by you; (iv) any breach of legal provisions, or infringement upon the rights of any User or third-party entity by you; (v) any failure on your part to uphold the assurances provided in Section 2; (vi) any content you've presented, or that has been presented via your account on the Platform, especially if such content may violate the intellectual property rights of another party or be deemed illegal; and (vii) if you are a Client, any actions or neglects of any Client Representative. Jobbit retains the exclusive right, at its sole discretion, to take on the primary defense and handling of any issue that otherwise demands indemnification by you. Without obtaining prior written approval from Jobbit, you shall not conclude any claim or matter or enter into any settlement agreements.
To promote swift and cost-effective solutions for any conflicts, issues, or claims related to your interactions with the Platform, your affiliations with Jobbit, tasks, or these Terms & Conditions (including prior versions) (collectively referred to as "Conflict"), both you and Jobbit commit to trying to settle any Conflict via negotiations for a minimum of thirty (30) days before initiating any alternative dispute resolution methods (like mediation or arbitration) or initiating court actions (barring any specifics mentioned in Section 28). The negotiations process will begin once a written notification is given. Your designated address for such notices is the one tied to your Jobbit account, and an electronic copy shall be sent to the email address you've shared with Jobbit. 20.1.1. You recognise and concur that (i) this Agreement is solely between you and Jobbit, with Apple being an external entity to this Agreement, except as a third-party beneficiary as outlined further, and (ii) Jobbit, not Apple, is exclusively accountable for the Application from App Store and its content. Your engagement with the Application from App Store must align with the App Store's Terms of Service.
20.1.2. You are aware that Apple is not mandated to offer any maintenance or support services concerning the Application from App Store.
20.1.3. Should the Application from App Store not adhere to any given warranty, you can inform Apple, resulting in Apple refunding the application's purchase price to you. Beyond this, as per the prevailing laws, Apple won't hold any warranty obligations related to the Application from App Store. Between Jobbit and Apple, any other repercussions, losses, obligations, damages, costs, or charges due to warranty non-conformity will be Jobbit responsibility, always considering the warranty conditions and exclusions in this Agreement.
20.2. Both you and Jobbit acknowledge that, concerning each other and Apple, Apple does not shoulder the responsibility of handling any grievances you or any third-party may have regarding the Application from App Store or your utilisation of it. This encompasses: (i) claims related to product liability; (ii) assertions that the Application from App Store doesn't satisfy relevant legal or regulatory standards; and (iii) issues emerging from consumer rights or analogous laws.
20.3. In scenarios where a third party asserts that the Application from App Store or your utilisation of it infringes upon their intellectual property, Jobbit (not Apple) will be the primary entity responsible for examining, defending, resolving, and discharging any such intellectual property breach claims, but only as mandated by this Agreement.
20.4. You understand and agree that Apple and its subsidiary entities are third-party beneficiaries of these Terms & Conditions concerning your use and licensing of the Application from App Store. Upon your endorsement of these Terms & Conditions, Apple is entitled (and will be presumed to have accepted the entitlement) to enforce these Terms & Conditions against you pertaic ing to your Application from App Store license as its third-party beneficiary.
You are bound to adhere to any relevant third-party terms when utilising the Application from App Store, without undermining any other clauses of this Agreement.
21.1.1. You recognize and concur that (i) this Agreement is solely fdcbetween you and Jobbit with Google being an external entity to this Agreement, except as a third-party beneficiary as outlined further, and (ii) Jobbit, not Google, is exclusively accountable for the Application from Google Play and its content. Your engagement with the Application from Google Play must align with the Google Play Terms of Service.
21.1.2. You are aware that Google is not mandated to offer any maintenance or support services concerning the Application from Google Play.
21.1.3. Should the Application from Google Play not adhere to any given warranty, you may inform Google, resulting in Google refunding the application's purchase price to you. Beyond this, as per the prevailing laws, Google won't hold any warranty obligations related to the Application from Google Play. Between Jobbit and Google, any other repercussions, losses, obligations, damages, costs, or charges due to warranty non-conformity will be Jobbit's responsibility, always considering the warranty conditions and exclusions in this Agreement.
21.2. Both you and Jobbit acknowledge that, concerning each other and Google, Google does not shoulder the responsibility of handling any grievances you or any third-party may have regarding the Application from Google Play or your utilization of it. This encompasses: (i) claims related to product liability; (ii) assertions that the Application from Google Play doesn't satisfy applicable legal or regulatory standards; and (iii) issues emerging from consumer protection or similar laws.
21.3. In scenarios where a third party asserts that the Application from Google Play or your utilization of it infringes upon their intellectual property, Jobbit (not Google) will be the primary entity responsible for examining, defending, resolving, and discharging any such intellectual property infringement claims, but only as mandated by this Agreement.
21.4. You understand and agree that Google and its subsidiary entities are third-party beneficiaries of these Terms & Conditions concerning your use and licensing of the Application from Google Play. Upon your acceptance of these Terms & Conditions, Google is entitled (and will be presumed to have accepted the entitlement) to enforce these Terms & Conditions against you pertaining to your Application from Google Play license as its third-party beneficiary. You are bound to adhere to any relevant third-party terms when utilizing the Application from Google Play, without undermining any other clauses of this Agreement.
These Terms & Conditions does not establish any form of agency, collaboration, partnership joint venture, employment, or any franchiser-franchisee association between you and Jobbit and nothing in these Terms & Conditions shall grant you the authority to bind Jobbit in any way.
Any failure by Jobbit in upholding the terms of this Agreement should not be interpreted as a waiver of any such right or provision. These Terms & Conditions constitute the entire understanding between you and Jobbit Ltd concerning its subject matter, overriding any previous understandings or communications. These Terms & Conditions doesn't however replace other specific agreements you may hold with Jobbit on different subject matters, such as the terms related to certain service categories. If any provision is deemed partially or entirely unenforceable or illegal, (i) it will be adjusted to make it enforceable and compliant, or (ii) if it can't be adjusted, it will be removed from these Terms & Conditions without impacting the other terms' enforceability. You accept that we can reassign or transfer these Terms & Conditions without requiring your approval, including transfers to: (i) an Affiliate or subsidiary, (ii) an entity acquiring assets, or (iii) any succeeding entity. Once the assignment becomes operative, (a) Jobbit will be discharged from future obligations towards you post the assignment date, and (b) the entity receiving the assignment will uphold the terms of these Terms & Conditions in place of Jobbit. You may not transfer or assign these Terms & Conditions without our express written consent. Any unauthorised assignment contrary to this Section 22 will be considered invalid. Provisions within these Terms & Conditions that naturally should survive its termination will remain effective even after these Terms & Conditions terminates or your interaction with the Platform ceases.
Individuals providing services on Jobbit are responsible for independently identifying and obtaining any necessary licenses, permits, or registrations before undertaking any job. Certain jobs may be strictly prohibited, and Service Providers must refrain from engaging in these restricted activities. Violations may lead to legal consequences, including potential fines. In cases of uncertainty about how national, regional, or local laws apply to services on the Platform, it is advisable to seek guidance from legal experts. Jobbit does not oversee, guide, or assess the expertise of individuals performing jobs. Therefore, it is the responsibility of Clients to assess whether an individual possesses the appropriate skills and knowledge for the required service. Clients may also consider checking national, regional, or local regulations to determine if specific jobs require a certified or registered professional. It is beneficial for Clients to engage in discussions with their service provider(s) regarding any specific challenges or barriers at the job site that may impact the execution of the job. This proactive communication helps ensure a clear understanding of the job requirements and promotes a successful service experience for both Clients and Service Providers.
Jobbit retains the unequivocal right to adjust, revise, expand, enhance, halt, or abolish any part of these Terms & Conditions. Furthermore, Jobbit has the liberty to examine, refine, adjust, or cease, either for a short span or indefinitely, the Platform or any associated content, at any point in time, and this can take effect immediately with or devoid of any prior notification, without holding Jobbit liable. Limits on specific features or restricting access to certain parts or the entirety of the Platform may also be imposed by Jobbit without prior notice or liability. While Jobbit will strive to inform you of significant amendments to these Terms & Conditions via email, it assumes no liability for any potential oversight in doing so. If any upcoming modifications to these Terms & Conditions are not acceptable to you or create potential non-compliance, you are required to immediately deactivate your account and cease using the Platform forthwith. Persisting in the use of the Jobbit platform after modifications to this Agreement indicates your unconditional acceptance of all such modifications.
These Terms & Conditions are designed exclusively for the Parties and their authorised successors and assigns. They should not be interpreted as granting any third-party rights (except as detailed in Section 20) or to allow any individual or entity other than the User to hold any entitlement, remedy, responsibility, compensation, legal recourse, or any other form of action related to or arising from any terms or provisions herein. Only the parties directly involved in these Terms & Conditions may enforce its terms. The foregoing notwithstanding, a Client Representative may take actions in the name and interest of the Client.
You grant permission to obtain all contracts, alerts, revelations, and other messages (hereafter referred to as "Notifications") linked to this Agreement in an electronic format, which could be via methods such as email or by displaying Notifications on the Jobbit website. You concur that every Notification presented to you digitally fulfils any legal mandate necessitating such correspondence to be in a tangible written form. Unless stated differently within these Terms & Conditions, all notifications in the context of these Terms & Conditions must be scripted and are considered appropriately delivered upon reception if hand-delivered or dispatched through certified or registered post with an acknowledgment of receipt; upon electronic affirmation of delivery if sent via email; or on the date indicated by the tracking details of a renowned overnight delivery service if forwarded for next working day delivery.

By accessing the Platform, you consent to conduct transactions electronically via the Platform. Furthermore, you acknowledge that: (i) your digital signature carries the same legal weight, authenticity, and binding nature as a signature penned on paper; (ii) using a keyboard, mouse, or other devices to select an option, button, or icon is equivalent to providing a written signature by you; and (iii) there's no need for a certification authority or any external validation to confirm your digital signature, and the absence of such certification or verification doesn't compromise the validity of your electronic endorsement in any manner.
Should there be any conflicting or divergent positions between these Terms & Conditions and the provisions tailored for specific jurisdictions, the latter will take precedence and be the authoritative guide for Users situated within those respective regions.
These Terms & Conditions constitute a legally binding agreement between you and us, governing your use the Jobbit Platform. Your use of the Platform is subject to compliance with these Terms & Conditions, as well as our Privacy Policy and any other guidelines or policies referenced herein. These Terms & Conditions are applicable to all Users, visitors, and others who access or use our Platform. Please review these Terms & Conditions carefully to ensure your understanding of your obligations, rights, and responsibilities when using the Platform. Your access to and use of our services imply your acceptance of these Terms & Conditions. If you have any concerns or disagreements with any part of these Terms & Conditions, please do not proceed with using the Platform.
