5.5 AI Transparency

5.5.1 In accordance with emerging UK and EU AI transparency requirements, you acknowledge that:

6. Biometric Data and Deepfake Policy

6.1 Biometric Data Processing

6.1.1 Certain AI Tools (including Face Swap, Motion Sync, Avatar, Photoshoots, and AI Stylist) process Biometric Data. Under UK GDPR, Biometric Data processed for the purpose of uniquely identifying a person constitutes special category data, which requires an Article 9 condition for processing.

This consent is separate from your acceptance of these Terms and is collected through a dedicated consent mechanism within the relevant tool. You shall indemnify Jobbit against any claims, losses, or liabilities arising from your failure to obtain such consent.

7. AI Agent: Scope, Authority, and Liability

IMPORTANT: This Clause 7 contains important provisions about the AI Agent feature. Please read it carefully. The AI Agent is an autonomous system that takes actions on your behalf, including committing you to financial obligations and arranging services with Freelancers.

7.1 What the AI Agent Does

7.1.1 When you submit a natural-language instruction to the AI Agent, the Agent may:

7.2 Scope of Authority

7.2.1 By submitting an instruction to the AI Agent, you grant the Agent authority to act on your behalf within the following parameters:

7.3 Autonomous Actions and Disclosure

7.3.1 You acknowledge and agree that the AI Agent may take autonomous digital actions without seeking your approval for each step, including searching the internet, comparing service providers, generating itineraries, sending booking confirmations, and communicating task details to Freelancers on your behalf. The Agent will maintain a full activity log accessible through your account dashboard.

7.4 Allocation of Risk and Liability

7.4.1 Responsibility for AI Agent actions is allocated as follows:

7.5 Limitations of the AI Agent

7.5.1 The AI Agent is an evolving technology. You acknowledge that:

8. Freelancer Marketplace

8.1 Independent Contractor Status

8.1.1 Freelancers on the Platform are independent contractors. They are not employees, workers, or agents of Jobbit. Jobbit does not control or direct how Freelancers perform their services. Freelancers set their own rates (subject to any Platform minimum or maximum), choose which jobs to accept, provide their own tools and equipment, and determine their own working methods. Nothing in these Terms or in the operation of the Platform creates an employment, partnership, joint venture, or agency relationship between Jobbit and any Freelancer.

8.2 Verification and Vetting

8.2.1 The Platform refers to Freelancers as “verified professionals.” This means that Jobbit has:

8.2.2 “Verified” does not mean that Jobbit has independently audited the Freelancer’s qualifications, conducted a criminal background check (unless explicitly stated for a particular service category), or guaranteed the quality of any services. Users should satisfy themselves as to the suitability of any Freelancer before engaging their services.

8.3 Regulated Trades and Professions

8.3.1 Certain service categories on the Platform (including but not limited to plumbing, locksmith services, electrical work, gas work, and fitness coaching) may involve regulated activities requiring specific qualifications, registrations, or insurance. Freelancers in these categories are required under the Freelancer Terms of Service to:

8.3.2 Jobbit does not independently verify ongoing compliance. If you have concerns about a Freelancer’s qualifications or regulatory status, you should request evidence directly from the Freelancer before engaging their services.

8.4 Contractual Relationship

8.4.1 When you engage a Freelancer through the Platform (whether directly or via the AI Agent), the contract for the provision of Services is formed between you and the Freelancer. Jobbit’s role is limited to:

8.5 Ratings, Reviews, and Disputes

8.5.1 Users may leave ratings and reviews following the completion of a Service. All reviews must be honest, fair, and based on genuine experience. Jobbit reserves the right to remove reviews that are fraudulent, defamatory, or in breach of these Terms. For disputes between Users and Freelancers, see Clause 14.

9. Payments, Credits, and Referral Programme

9.1 Payment Processing

9.1.1 Payments on the Platform are processed by Stripe, Inc. When you make a payment on the Platform, you are authorising Stripe, Inc to process the transaction. Jobbit does not store your full payment card details.

9.2 Credits

9.2.1 Credits may be purchased through the Platform at the prices displayed at the time of purchase.

9.2.2 Credits expire 12 months from the date of purchase unless otherwise stated at the time of purchase.

9.2.3 Credits have no monetary value outside the Platform. They are non-transferable and may not be sold, traded, or exchanged for cash.

9.2.4 Unused, unexpired Credits may be refunded upon request, subject to any applicable deductions for Credits already consumed. Refund requests must be made within 14 days of purchase for a full refund (in accordance with the Consumer Contracts Regulations 2013), or within 30 days thereafter for a pro-rata refund.

9.2.5 Credits that have been used for AI Tool processing or applied to Freelancer service fees are non-refundable except where you have a statutory right to a refund under the Consumer Rights Act 2015.

9.3 Freelancer Payments

9.3.1 Payments for Freelancer services are processed through the Platform. Jobbit holds funds on behalf of the User and releases payment to the Freelancer upon confirmed completion of the task, or in accordance with any milestone payment structure agreed between the User and Freelancer. Jobbit charges a service fee of up to 25% on each transaction, deducted from the Freelancer’s payment.

9.4 Referral Programme

9.4.1 Eligible Users may earn bonus Credits by referring new Users to the Platform through the referral mechanism provided.

9.4.2 Referral rewards are non-transferable, have no cash value, and are subject to the same expiry and usage terms as purchased Credits.

9.4.3 You must not distribute referral links in bulk, through spam, or in any way that violates applicable anti-spam legislation.

9.4.4 Jobbit reserves the right to modify, suspend, or terminate the referral programme at any time, with reasonable notice to participants.

9.4.5 Jobbit reserves the right to revoke referral rewards obtained through fraudulent or manipulative means.

10. Consumer Rights

10.1 Statutory Rights

10.1.1 Nothing in these Terms affects your statutory rights as a consumer. Under the Consumer Rights Act 2015, digital content supplied through the Platform (including AI Tool functionality) must be of satisfactory quality, fit for a particular purpose, and as described. If digital content does not meet these standards, you may be entitled to a repair, replacement, or refund.

10.2 Right of Cancellation

10.2.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a distance contract within 14 days of the date of the contract without giving any reason. To exercise this right, you must inform us of your decision to cancel by a clear statement to ‘business@jobbit.uk’.

10.2.2 If you have requested that the supply of digital content begins before the end of the 14-day cancellation period, you acknowledge that you will lose your right of cancellation once the digital content has been fully supplied.

10.3 Freelancer Services

10.3.1 Cancellation of Freelancer services is governed by the terms agreed between you and the Freelancer at the time of booking. Where the AI Agent has arranged a service on your behalf, the cancellation terms applicable to that service will be made available to you in your task summary before any commitment is confirmed.

11. Data Protection and Privacy

11.1 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003. Our Privacy Policy sets out in full:

11.2 Automated Decision-Making

11.2.1 The AI Agent and AI Tools involve automated decision-making. In accordance with the Data (Use and Access) Act 2025 and the UK GDPR, you have the right to:

11.3 Cookies

11.3.1 Our Cookie Policy, available with our supplemental policies document, explains how we use cookies and similar technologies. By using the Platform, you consent to our use of cookies in accordance with that policy and the Privacy and Electronic Communications Regulations 2003.

12. Acceptable Use Policy

12.1 The full Acceptable Use Policy is available in our supplemental policies and is incorporated into these Terms by reference. In summary, you must not use the Platform to:

12.2 Enforcement: Violations will result in a graduated response: (i) warning and content removal; (ii) temporary account suspension; (iii) permanent account termination; and (iv) reporting to law enforcement where the violation constitutes or may constitute a criminal offence.

13. Jobbit Protection

13.1 Jobbit Protection is a discretionary scheme designed to help resolve issues that may arise during Services arranged through the Platform. It is not an insurance policy and does not create any legal obligation on Jobbit to pay compensation.

13.2 Eligibility

13.2.1 To be eligible for Jobbit Protection, you must:

13.3 Scope

13.3.1 Jobbit may, in its sole discretion, offer compensation of up to £1,000 per incident for direct property damage or personal injury arising from the performance of a Service booked through the Platform.

13.4 Exclusions

13.4.1 Jobbit Protection does not cover: loss of earnings or profits; damage to common areas; pre-existing damage; any loss arising from the User’s own instructions, negligence, or breach of these Terms; or any loss that is covered by the User’s or Freelancer’s own insurance.

13.5 Resolution

13.5.1 If a claim is approved, the User must execute a Jobbit Resolutions Agreement, release Jobbit from further liability in relation to the claim, and refund any amounts subsequently determined to have been erroneously paid.

14. Dispute Resolution

14.1 Internal Complaints

14.1.1 If you have a complaint about the Platform or any Service, you should first contact us at ‘business@jobbit.uk’. We will acknowledge your complaint within 5 working days and aim to provide a substantive response within 15 working days.

14.2 User-Freelancer Disputes

14.2.1 Disputes between Users and Freelancers should first be resolved directly between the parties. If direct resolution fails, either party may request that Jobbit facilitate mediation through the Platform. Jobbit’s role in mediation is limited to facilitating communication; Jobbit is not an arbitrator and will not impose a resolution.

14.3 Online Dispute Resolution

14.3.1 In accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we inform you that the European Commission’s Online Dispute Resolution platform is available at https://ec.europa.eu/odr. We are not currently obliged to participate in ADR proceedings before a consumer arbitration body, but we will consider doing so on a case-by-case basis.

14.4 Governing Law and Jurisdiction

14.4.1 These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, provided that nothing in this clause limits your rights as a consumer to bring proceedings in the courts of the country in which you are domiciled.

15. Limitation of Liability

IMPORTANT: This Clause 15 sets out the entire financial liability of Jobbit to you. Please read it carefully.

15.1 Unlimited Liability

15.4 Fairness

15.4.1 The limitations and exclusions in this Clause 15 are considered fair and reasonable having regard to the nature of the Platform, the fact that Jobbit acts as an intermediary and not a provider of services, and the availability of Jobbit Protection under Clause 13.

16. Indemnification

16.1 User Indemnity

16.1.1 You agree to indemnify, defend, and hold harmless Jobbit Ltd, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

16.2 Proportionality

16.2.1 This indemnity is without prejudice to your statutory rights as a consumer. The indemnity obligations in this clause shall not apply to the extent that the relevant claim arises from Jobbit’s own negligence, wilful misconduct, or breach of these Terms.

18.2 We will use reasonable efforts to mitigate the impact of any force majeure event and will resume performance as soon as reasonably practicable.

19. General Provisions

19.1 Entire Agreement

19.1.1 These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any supplemental terms applicable to specific features, constitute the entire agreement between you and Jobbit in relation to your use of the Platform and supersede all previous agreements, representations, and arrangements.

19.2 Severability

19.2.1 If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If it cannot be so modified, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

19.3 Waiver

19.3.1 No failure or delay by Jobbit in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy preclude any other or further exercise of that or any other right or remedy.

19.4 Assignment

19.4.1 You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Jobbit may assign or transfer its rights and obligations under these Terms to any affiliate or to any successor in connection with a merger, acquisition, or sale of all or substantially all of its assets, provided that such assignment does not materially reduce your rights under these Terms.
